The Website is an informational and marketing site presenting our company, our products, and ways to contact us. The Website itself does not provide accounts, paid subscriptions, or product functionality.

The Website is a marketing and information site. It does not require an account. We collect the following limited categories of personal information:

• Contact form submissions: when you fill in the contact form, we collect the name, email address, and message content you provide.
• Request metadata: standard request data such as IP address, user agent, approximate country of origin, and timestamps. This is processed by our hosting and edge provider (Cloudflare) for security, abuse prevention, and request routing.
• Bot protection signals: when you submit the contact form, Cloudflare Turnstile collects technical signals (such as browser characteristics and behavioral data) to verify that the submission is from a human and not a bot.

The Website does not run advertising, marketing, retargeting, or cross-site tracking. We do not currently run any web analytics on the Website.

We use the information collected through the Website to:

• respond to your inquiries submitted via the contact form and provide related support follow-up;
• operate, secure, and maintain the Website, including preventing fraud, spam, and abuse;

Sparky Code, S.A.S. de C.V. is established in El Salvador. The Website is a global service, and personal data submitted through it is processed in the United States and other jurisdictions where our sub-processors operate.

For users in the European Economic Area, the United Kingdom, or Switzerland, we rely on the European Commission's Standard Contractual Clauses (SCCs) and the equivalent UK Addendum to lawfully transfer personal data to processors outside the EEA. Where a sub-processor is certified under the EU–U.S. Data Privacy Framework, we additionally rely on that adequacy mechanism.

By using the Website, you understand that your personal data may be transferred to and processed in countries that may have different data protection laws than your country of residence.

Request metadata processed by Cloudflare (such as edge access logs) is retained according to Cloudflare's standard log retention, which is typically short-lived.

8. Security

We implement industry-standard security measures to protect your data, including encryption in transit (HTTPS / TLS), Cloudflare Turnstile for bot protection on the contact form, a strict Content Security Policy, HTTP Strict Transport Security (HSTS), and other defensive HTTP headers. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

9. Cookies and Similar Technologies

The Website itself does not set cookies. On the contact page, Cloudflare Turnstile may set strictly necessary cookies for the sole purpose of protecting the form against bots and abuse.

We do not use advertising, marketing, retargeting, analytics, or cross-site tracking cookies on the Website. Because we use only strictly necessary cookies, no cookie consent banner is required under the EU ePrivacy Directive or the GDPR. If we ever introduce non-essential cookies, we will request your consent first via a banner.

You can disable cookies in your browser, but the contact form's bot protection may not function correctly.

10. Your Rights

Depending on your location, you may have rights regarding your personal data, including the rights to access, rectify, erase, restrict processing of, object to the processing of, and port your personal data. You may also have the right to lodge a complaint with your local data protection authority.

11. EU/UK Representative

Sparky Code, S.A.S. de C.V. is established in El Salvador. As of the date of this policy, we have not appointed an Article 27 GDPR representative in the EU or UK. We will appoint a representative if and when our processing of EEA/UK personal data meets the thresholds requiring one.

The Website is not directed to individuals under the age of 16. We do not knowingly collect personal information from children. If you believe a child has submitted personal data to us, please contact us so that we can delete it.
